Hohfeld’s analysis on the different types of rights and duties is highly influential in analytical legal theory, and it is considered as a fundamental theory in AI&Law and normative multi-agent systems. Yet a century later, the formalization of this theory remains, in various ways, unresolved. In this paper I provide a formal analysis of how the working of a system containing Hohfeldian rights and duties can be delineated. This formalization starts from using the same tools as the classical ones by (...) Kanger and Lindahl used, but instead of focusing on the algebraic features of rights and duties, it aims at providing a comprehensive analysis of what these rights and duties actually are and how they behave and at saying something substantial on Power too—maintaining all along the Hohfeldian intentions that these rights and duties are sui generis and inherently relational. Iurii Kovalenko.Orthodox theological understanding of church-state relations in Ukraine at the time of development of Media and Information Technology. The author, who for many years was the press-secretary to the Primate of the Ukrainian Orthodox Church, considers continuity UOC position on the principles of church-state relations and their genesis in accordance with the socio-political processes taking place in Ukraine, the development of media and information technology.

In this research, author analyzes and interprets data of sociological researches of the Razumkov Centre concerning the religious self-identification of Ukrainian citizens, their attitude towards the Church in general and towards the denominations and religions presented in Ukraine in the dynamics from the year 2000 to nowadays. The author also considers external and internal outlook trends and shows a dangerous contradiction between them. As an alternative to solve this conflict, the author suggests the idea of Open Orthodoxy and presents an (...) example of its implementation in projects of the Open Orthodox University of Saint Sophia the Wisdom. In the resolution of the Central Committee of the CPSU entitled "On the Periodical Kommunist," the study of the dialectics of the forces and relations of production is assigned to the sphere of economics. It is no accident that the question is posed in this way. Today, under conditions of restructuring, a concrete analysis of the economic connections, contradictions, and interactions of socialist society and of the real forms of manifestation of economic relations is more important than ever. The [current] (...) criticism of erroneous views, widespread in their time, about the exceptional character of the economic system of socialism that made it possible to "constitute" productive relations through the "creative force of the economic plan," is especially timely and substantive. However, a more general sociophilosophical study of the dialectics of the forces and relations of production is also necessary. Lenin's words have never lost their vital force: we cannot take up "particular questions without first solving the general question. …"' It is from these general sociophilosophical positions that we shall be examining some aspects of this topic that we think important. Authors of Greek and Roman philosophical protreptics imitate a kind of exhortation initially associated with Socrates, creating a thread of typically protreptic intertextuality that classifies protreptic as a genre of philosophical literature. Tracing this intertextuality from the Socratic authors to Boethius, the book shows how Greek and Roman protreptics define philosophy as a revisionary form of education, articulate the ultimate goals of this education, and associate their authors and audiences with philosophy as a new discursive practice and a new way (...) of living. The subject of this research is the period of Russian symphonic music of the 1960s. A new generation of composers – the “Sixtiers” – introduced a fresh modern musical language and remarkable artistic achievements. In first part of the article, the author dwell on several fundamental symphonic works by R. Shchedrin, S. Slonimsky, E. Denisov, Y. Falik, N. Karetnikov, as well gives general characteristics to this period. The second part of the article examines the compositions by A. Schnittke and L. (...) Prigozhin. Special attention is turned to the Symphony No.3 by Boris Tishchenko, who opens new stylistic horizons and encompasses the key trends of modern music, including the avant-garde, into his stylistic orbit. This article is first to consider B. Tishchenko's outstanding Symphony No.3 in the context of stylistic and linguistic innovations of the 1960s, which defines the scientific novelty. Analysis is conducted on the role and place of the youngest composer of the “Sixtiers” B. Tishchenko in the struggle for the “new music”. The conclusion is made that Tishchenko was one of the leaders in revival of the Russian music of the late XX century, and his Symphony No.3 reflects the pursuits of the postwar generation of Soviet composers to the fullest. The subject of the study is the period of Russian symphonic music of the 1960s. A new generation of "sixties" composers has entered the Soviet music scene, imperiously declaring themselves with bright creative achievements, fresh and modern musical language. The epoch of the turning point dictated a new reality, required new artistic thinking, generated diverse creative ideas. The panorama of Russian music was quite colorful, many things in art appeared and disappeared very rapidly, stylistic pluralism, lost at the dawn of (...) Soviet power, returned to the music scene. Special attention is paid to the works of composers of the Leningrad school — S. Slonimsky, Y. Falik, L. Prigozhin and V. Gavrilin. All of them opened new stylistic horizons and absorbed into their sound orbit the main trends of modern music, including the conquests of the Western avant-garde.  The scientific novelty of the work consists in the fact that the author examines the bright and original works of young Leningrad authors in the context of stylistic and linguistic innovations of the 1960s. The article analyzes the role and place of "Sixties" composers in the struggle for "new music". The main conclusion of the article is the idea that the period of musical renewal of the 1960s under consideration turned out to be extremely saturated with the most complex and diverse problems: ideological, general aesthetic, musical style. S. Slonimsky, Y. Falik, L. Prigozhin, V. Gavrilin became undisputed leaders in the renewal of Russian music of the second half of the twentieth century, and their works-"symbols" fully reflected the intense search of the post-war generation of Soviet composers. The subject of this research is the period of Soviet music in the 1960s. A new generation of the composers – the “Sixtiers” – came upon the stage, demonstrating remarkable artistic achievements, fresh and modern musical language. This article is dedicated to the symphonic work of the prominent Russian composer of the late XX century Boris Ivanovich Tishchenko. Particular attention is given to the Symphony No.1, which he created at the age of 22. Tishchenko burst into the Soviet musical space (...) with creative fervor, and asserted himself as a tremendous and unique talent. His extemporaneous music pieces kept pace with the time, in unison with the global changes that took place in Russian symphonism. The scientific novelty lies in consideration of B. Tishchenko’s Symphony No.1 in context of stylistic and linguistic innovations of the 1960s. Detailed analysis is conducted on the role and place of Tishchenko — the youngest of the generation of “Sixtiers” – in the struggle for "new music". The main conclusion lies in the thought that Tishchenko was one of the leaders in the renewal of Russian music in the late XX century, and Symphony No.1 of his early period fully reflected the intense pursuits of the post-war generation of the Soviet composers and opened the path towards the "new shores" in symphonic music of that time. This paper arose out of the 2017 international conference on AI and law doctoral consortium. There were five students who presented their Ph.D. work, and each of them has contributed a section to this paper. The paper offers a view of what topics are currently engaging students, and shows the diversity of their interests and influences.

This article provides the original perspective on esotericism. Two author distinguishes between the two polar directions of esotericism – "transcendental" and "latent" ; as well as introduces the two postulates characteristic to the first direction that in previous research received the name of "classical". The article discusses what binds esotericism and philosophy, religion, and art; outlines the common aspects of these fields of knowledge and life activity are indicated ; examines the cases of interaction, and what caused the decline of (...) interest in esoteric teachings. The research consists of two parts. The first part explores the three cases that reveal a close link between esoteric, philosophical, scientific and literary thought, as well as the fact that esoteric ideas and concepts often enrich philosophy, science and art. The second part discusses the key reasons for the slump in esotericism: new cultural challenges that to which there is yet no esoteric answer, interception of esoteric discourse in a number of directions of contemporary art and philosophy. However, this pause is temporary, since esoteric path is one of the ways to prevail in personality culture; it can be assumed that esotericists will soon eliminate the existing gap. On the example of current interest in vampires, the author discusses certain peculiarities of the phenomenon of mysticism, which indicate that the phenomenon of vampirism is real, perhaps related to the forms of communication widely used in modern life. The formal analysis of normative systems has traditionally focused on their deontic dimension rather than on their potestative dimension; yet, a growing amount of works aims at shedding light on the notion of power, its norm changing potential and its general interactions with deontic concepts. The present article contributes to this line of inquiry by adopting the following perspective: a normative system can be metaphorically seen as an agent that allocates abilities (powers) in order to promote the fulfillment of certain (...) desires (deontic directives), and in doing so regulates its behavioural domain. Our analysis emphasizes the instrumental nature of power, while clarifying the distinction between ‘being allowed’ and ‘being enabled’ and unveiling new patterns of interaction between deontic and potestative concepts. Operationally, we formulate this framework in terms of conditional rules, and provide a corresponding logic programming (ASP) implementation. (shrink)

The author discusses the concept of an ideal object. The statement of O.I. Genisaretsky is quoted and problematized, stating that the obligatory feature that has been preserved for the object and the terms "object" and "ideal object" is, apparently, its representability or visibility. The author shows that ideal objects began to be created during the formation of ancient philosophy and thinking. Faced with contradictions, ancient thinkers dealt with this situation in different ways. If Protogoras recognized the right of the reasoners (...) to receive contradictions and, accordingly, to consider the world contradictory, then Parmenides considered the world consistent, arguing that the criterion for the correctness (truth) of knowledge is not a reasoning person, but this world, existence, which still needs to be reached with the help of correct thought. It was within the framework of the implementation of the Parmenides program that ideal objects began to be created, which, as the author shows, performed three main functions: they allowed us to think consistently, to know the world and its phenomena, to comprehend and interpret empirical phenomena (facts) in a different way. Based on the case of Plato's "Feast", the semiotic schemes on the basis of which Plato creates ideal objects are analyzed. It is argued that it is impossible to build ideal objects, bypassing schemes, since their inventors (creators) are people. By solving problems, they synthesize meanings belonging to different areas of consciousness. The analysis of Galileo's "Conversations" allowed the author to suggest that the construction of ideal objects is due to the historical type of philosophical or scientific thinking. The author considers it necessary, before claiming to create a modern doctrine of ideal objects, to analyze the main typical cases of the construction of these objects in philosophy and science, and such an analysis can make significant adjustments to the understanding of the nature and features of this concept. Nevertheless, he suggests, it is already clear that the construction of ideal objects is an important link in philosophical, scientific and a number of other types of thinking. (shrink)

The article proposes to consider the phenomena of life and death within the framework of philosophical and scientific discourse. The author does not aim to explain the origin of life, he seeks to conceive of life and death on the basis of the methodology developed by him and the research conducted. The main way of understanding these phenomena is the hypothesis about the nature of the mechanism of life, as well as cultural–historical and semiotic analysis of the evolution of life. (...) In evolution, the author distinguishes three main stages: the formation of life, biological evolution and the evolution of social life. An important role in the latter is assigned, on the one hand, to the use of signs denoting not observable realities, but necessary for the management of the "primary team", on the other hand, technology. The technique performed two main functions: it expanded the capabilities of hominids in terms of creating the right environment and confirmed the use of signs, since it created a reality corresponding to their meanings. In social life, as well as in biological, two spheres need to be distinguished in the vital organization: one belongs to individuals, and the other, actually social, encompassing, without which the first cannot exist and function. Having asked the provisions indicated here, the author characterizes what death is and considers the cognitive dissonance that occurs when we try to rationally think about these phenomena. (shrink)

The article examines the history of the development of the ideas of semiotics, from the works of St. Augustine to the present. The author shares the semiotic approach, which, judging by the literature, was formulated by Augustine, and semiotics as a scientific discipline, and in two versions, as an analogue of mathematics and natural science. The characteristic of the semiotic approach presented by Augustine in the scheme is given, which, the author shows, can be extended to various humanitarian objects. Based (...) on the semiotic approach and classifications of signs, various variants of semiotics as a science were created in the XIX and XX centuries. The difference of scientific semiotics is explained: semiotics solved different problems and tasks, semiotically comprehended different subject areas, proceeded from a different understanding of science. Nevertheless, in all variants of semiotics, relations between the components of the sign were established. The semiotics reform project proposed by G.P. Shchedrovitsky is considered, and what came of it. Based on the analysis of two cases, the author outlines another version of semiotics, which he calls "expressionism". Although the methodology proposed by him allows analyzing and comprehending a fairly wide range of expressions and works of art, the author suggests not to consider it universal. (shrink)

This article discusses the conditions for delimitation of modernity and futureculture, as well as the concept of modernity. Vadim Belyaev claims that what the author refers to as futureculture, in fact does not go beyond the boundaries of modernity; these are rather the processes of promodernity and countermodernity. Vyacheslav Maracha polemicizes with Belyaev’s statements. Belyaev substantiates his critical rhetoric, gives characteristics to his interpretation of modernity, and claims that the author did not explain the thesis on the completion of modernity (...) and the establishment of futureculture. The author partially agrees with the criticism and provides additional arguments: characterizes the definition of modernity used by him; distinguishes between the new worldview, semantic reality of culture, and projects of modernity, realization of these projects and objective reality results from implementation of the projects of modernity and responses to new challenges of the time, as well as construction of the social institutions of modernity. The latter statement is illustrated on the example of the formation of state institution, the study by Martin van Creveld “The Rise and Fall of the State”. The conclusion is made that all plans and fundamental structures of modernity can no longer ensure normal flow of modern life, but rather generate problems and social destructions. Objectively, modernity has been reborn and is nearing completion. The author formulates certain ideas and meaning that reveal the formation of the future culture. (shrink)

The article discusses the meaning and content of the concept of nothingness introduced by S.S. Neretina in the book "The Earth Hums with a metaphor". Philosophy and Literature" (short story "Lermontov: the semantics of repetitions"). The author identifies five main characteristics in this view: nothing as freedom (where freedom is understood by Neretina "as peace, silence, silence, love and – as "I"); nothing as balancing on the verge of being and non-being; as an opportunity to express this reality in poetry, (...) while philosophy makes it impossible to think of anything"; nothing as a denial of everything, including life; finally, nothing is set as a reality opposed to culture. In this interpretation, nothing is a rather complex semantic formation, but generally understandable, if we keep in mind the task that Neretina solves: on the one hand, she finds out the relationship between literature and philosophy, on the other, she thinks through Lermontov's dramas. Neretina claims that Lermontov, like Goethe, was a special poet – poet-philosopher, he, as a thinking person, following such Russian thinkers and poets as, for example, Chaadaev and Pushkin, tried to understand why an honest, educated person "woe from wit", why he often ends up badly. The article discusses Lermontov's dual position as a poet and a latent thinker (philosopher), as well as the work of a modern writer who thinks through the existential problems of time in an artistic form. The author comes to the conclusion that the nothingness introduced by Neretina and attributed to Lermontov differs from the nothingness of St. Augustine, is given by the five listed characteristics, and represents a problem as an independent reality and whole. The distribution of organisms in morphologic space is clumpy. Cats are like felids, dogs are like canids and snails are (mostly) like gastropods. But cats are not like dogs and snails are not like clams. This clumpy distribution of morphology has long posed one of the greatest challenges to evolutionary biologists. Does it represent the extinction and disappearance of a oncecontinuous distribution of morphologies, clades perched on the summits of persistent selective peaks ala Sewell Wright, or a primary signature of (...) the evolutionary processes? And if the latter, what processes are responsible for generating it? Although often couched in discussions of the origin of higher taxa, such taxa are but proxies for this clumpy distribution, and ultimately the latter is the critical issue for macroevolution and for Stephen Jay Gould’s opus. Underneath all the controversies over whether species constitute individuals, whether speciation serves to divide intra-specific adaptation driven by natural selection from a set of inter- and supra-specific evolutionary processes, and over the impact of catastrophic mass extinctions on evolutionary trends, the fundamental issue is simply one of clumpiness (or, if you prefer, the inhomogeneous distribution of morphologies). Iurii Filipchenko, a Russian geneticist and the mentor of Theodosius Dobzhansky, introduced the term macroevolution in 1927 because he believed that the origin of the characters associated with higher taxa (those beyond the species level) required a different process of evolution. Filipchenko believed macroevolution was driven by cytoplasmic inheritance, but his general argument was consistent with other saltationists and macro-mutationists of the time, including the paleontologist Henry Fairfield Osborne and the geneticist Richard Goldschmidt. As it happened, I became acquainted with E.V. Il'enkov quite late, in the mid- or even the late 1960s. It was only a bit more than ten years before his death that I began to feel at home in his house, was able to visit without calling ahead, and was able to call him by his first name and the familiar "you"—that is, like many, many of not only his true friends but also like-minded thinkers, who became his close acquaintances, (...) most of whom justly considered themselves his pupils … The door would open wide, and Olia, Professor K.I. Salimova, Eval'd's wife and most devoted friend, not at all surprised by the unexpected guest and seemingly even quite happy at his arrival , would try first to draw him into the kitchen and feed him … which she more often than not succeeded in doing. I am not talking about myself: there were always many guests, and this is precisely how they arrived at the Il'enkovs' apartment. Recently, a critic in Literaturnaia gazeta recalled those whom he met in Eval'd's apartment in the 1960s: "This was a tight circle of like-minded thinkers," wrote the critic. "But some of them are no longer with us, while most are far away, beyond our borders." Obviously, he had not been in the house often or had forgotten things over the distance of years. There was no "circle," nor could there have been one—not with this host, not with his lifestyle and way of relating to people. I met a good hundred fine and various people in Eval'd's home: I.N. Korzhavin, V. Davydov, A. Meshcheriakov, S. Vinogradova, N. Dubinin, V. Zinchenko, A. Zinov'ev, Iu. Kamiakin, and … indeed, five pages would not be enough to list the quite famous and the not-quite-so-famous, simply ordinary people with no claim to fame. Nazym Khikmet, A.N. Leont'ev, and B.M. Kedrov were friends of the house … Ever new faces, figures, and words come to mind. I cannot forgive myself: once Eval'd Vasil'evich wanted to take me along to Iurii Liubimov's to read his play Neither God nor Tsar nor Hero … [Ni bog, ni tsar' i ni geroi], but I had some other business, something so important that I do not even remember now what it was, and it is probably not worth remembering. But most likely I was too timid to appear uninvited at the house of a person burning with creativity. The same thing happened with Galich … Eval'd liked especially his song about Zoshchenko. He did not sing it; he narrated it, but in such a way that tears always came to one's eyes. (shrink)

RESUMO Absurdo e falta de sentido são geralmente estudados como categorias filosóficas e/ou lógicas. Este artigo examina o absurdo como um fenômeno semiótico e como parte dos mecanismos de geração de significado. Argumenta que o problema do absurdo e do significado como um todo é, acima de tudo, um problema textual. Esta abordagem se fundamenta no legado do semioticista e estudioso da literatura Iúri Lótman, especialmente em seus conceitos de explosão e nas noções de “não-texto” e “menos- dispositivo”. O conceito (...) de absurdo destaca o inerente paradoxo informacional da cultura humana e de seus sistemas de comunicação, nos quais ruído, erros e contratempos não impedem a comunicação, pelo contrário, estimulam-na. Em uma escala maior, o exemplo de como as culturas humanas lidam com o “não-sentido” na comunicação tem implicações para o estudo da evolução da cultura e da linguagem humanas e também traz luz adicional ao problema metodológico da relação texto/signo. ABSTRACT Absurdity and nonsense are usually studied as philosophical and/or logical categories. This paper examines nonsense as a semiotic phenomenon and as part of the mechanisms of meaning generation, and argues that the problem of nonsense and meaning as a whole is foremost a textual problem. This approach is based on the legacy of the semiotician and literary scholar Iurii Lotman, and especially his concepts of explosion and the notions of “non-text” and “minus-device.” The concept of nonsense thus highlights the inherent informational paradox of human culture and human communication systems, in which noise, errors and mishaps do not impede communication but on the contrary, stimulate it. On a larger scale the example of how human cultures deal with ‘non-sense’ in communication has implications for the study of the evolution of human culture and language and also draws additional light to the methodological problem of the text/sign relation.
